Third Circuit Denies Coinbase Bid for Timely Crypto Rules, SEC Maintains Enforcement-First Path

Coinbase lost its bid to force the SEC into crypto rulemaking, and the ruling quietly strengthens the agency’s power to pick its targets. The Third Circuit’s decision means the exchange’s “right to petition” claim failed, so the SEC keeps its discretionary freedom to regulate or not regulate without a court-ordered timeline.

The petition grew out of Coinbase’s 2022 request that the SEC propose clear crypto rules. When the Commission stayed silent, the exchange sued, arguing that inaction was unlawful. The court rejected that framing. Judges ruled that an agency’s refusal to issue a rule is not the same as a final order, so there was nothing for an appeals court to review. In plain terms, Coinbase asked for a deadline; the court said it could not give one.

The immediate winner is the SEC. It keeps the ability to bring enforcement actions case-by-case without being pushed into broad rulemaking that might tie its hands. Coinbase and other platforms lose a potential shield; they cannot force regulators to draw bright lines before the next lawsuit lands. Traders and DeFi teams now operate under the same uncertainty that existed before the filing—only with confirmation that courts will not step in to shorten the wait.

That outcome tilts authority toward enforcement over rulemaking. The SEC can continue to treat many tokens as securities without first defining which ones, raising compliance costs for exchanges and DeFi protocols that must guess at classification. Stablecoin issuers and large trading venues face added legal spend as they prepare for possible enforcement rather than negotiated rule text. Retail traders absorb the risk in thinner liquidity and wider spreads whenever platforms preemptively delist borderline assets.

The ruling locks in a slow, enforcement-first regime; platforms that bet on eventual clarity just saw the timeline stretch again.
