The Seventh Circuit handed the CFTC a clean victory this week, upholding the agency’s authority to punish a family trust for unregistered commodity-trading activity. The ruling cements the CFTC’s broad enforcement reach and sends a warning shot across every corner of the crypto and derivatives markets that regulators will not tolerate attempts to hide behind trusts or other legal wrappers.
The Conway Family Trust had argued that its trading in futures and options did not trigger registration requirements because the trust was a passive investor, not a commodity trading advisor. The CFTC disagreed, fining the trust and ordering it to cease unregistered activity. On appeal, the court sided with the agency, finding that the trust’s regular, sophisticated trading crossed the line into advisory conduct under the Commodity Exchange Act.
