**CFTC Wins Key Ruling on Crypto Fraud Reach**

The Seventh Circuit just handed the CFTC a decisive win against James Donelson, affirming that the agency can pursue fraud claims even when no futures contracts are involved. The decision expands the CFTC’s authority over spot-market crypto trading and signals that “commodity” status alone may be enough to trigger federal oversight.

Donelson ran a trading group promising big returns on crypto and forex. The CFTC sued, alleging he lied about performance, hid losses, and misused customer funds. Donelson fought back, claiming the CFTC had no jurisdiction because the trades never touched regulated futures or swaps. The district court rejected that argument and entered summary judgment; Donelson appealed.

The Seventh Circuit agreed with the lower court. It held that the Commodity Exchange Act’s anti-fraud provision covers any transaction in a “commodity,” whether or not the instrument is a future or swap. Because bitcoin and ether are plainly commodities, the panel ruled, misrepresentations in crypto spot trading fall squarely inside the CFTC’s beat. The judges stressed that Congress wrote the statute broadly and that the agency need not prove a futures nexus.

In plain English, the ruling lowers the bar for the CFTC to police crypto platforms. If a token can be classified as a commodity—and most can—the agency can now bring fraud cases without showing that derivatives changed hands.
