Three lawsuits accusing a major digital-asset platform of selling unregistered securities have been left in separate federal courts after a judicial panel refused to bundle them into a single proceeding. The ruling keeps the litigation spread across Illinois, California, and Pennsylvania, raising the odds of conflicting rulings and a drawn-out fight over how the SEC’s authority reaches decentralized trading.

Plaintiff Anthony Motto asked the Judicial Panel on Multidistrict Litigation to move the cases to Chicago, arguing that all three claims hinge on the same question: whether the platform’s token constitutes an investment contract under federal law. Opposing counsel countered that the suits involve different state statutes, user agreements, and damages calculations, and that coordination would simply slow discovery. The panel agreed, finding that common factual threads were outweighed by procedural differences and the risk of one court’s calendar clogging the others.

With the actions now destined to proceed on parallel tracks, plaintiffs in each district can press distinct theories without waiting for a nationwide steering committee. Defendants, meanwhile, must defend the same product in three venues, multiplying legal spend and the chance that one adverse ruling could create persuasive precedent elsewhere. The split also hands the SEC an indirect advantage: inconsistent district-court opinions could invite appellate review that clarifies—or further muddies—the agency’s reach over secondary-market token sales.

For traders and exchanges, the decision underscores that classification fights will be waged locally long before any Supreme Court or congressional fix arrives. Expect defense budgets to rise, settlement math to turn on jurisdiction shopping, and DeFi protocols to weigh whether multi-district exposure is worth the innovation premium.
