**Texas Court Slaps Brakes on Crypto Mining Fight**
A Texas appeals court has handed Envy Blockchain a procedural lifeline in its battle with a local landowner, ruling that the company cannot be forced to litigate its mining facility dispute in the wrong county. The decision matters because it shows how state courts can still shape where—and how aggressively—crypto infrastructure gets challenged, even as federal regulators eye tokens and exchanges.
The fight started when neighboring landowner NV Landco and its principal Stephen Decani sued Envy over noise, traffic, and alleged property damage from the company’s Bitcoin mining operation. Envy tried to move the case out of Hudspeth County, arguing the claims were really about title to land and therefore belonged in the county where the real estate sits. When the trial judge refused, Envy asked the Eighth Court of Appeals in El Paso for an emergency writ of mandamus—an order telling the lower court to correct itself.
In a short per curiam opinion, the appellate panel agreed with Envy. It held that the underlying dispute is “in substance” a real-property action and that Texas venue rules require such suits to be brought where the land is located. The court ordered the Hudspeth County judge to transfer the entire case, giving Envy a home-field advantage and potentially slowing the plaintiffs’ momentum.
For crypto operators, the ruling is a reminder that local land-use fights can still derail mining projects even when regulators are focused on tokens and trading platforms. A win on venue does not decide who ultimately prevails, but it shifts costs, timelines, and settlement leverage—factors that matter to miners watching power contracts and community opposition.
