Texas Court Freezes Discovery in Envy Blockchain Case Ahead of Arbitration

Envy Blockchain and two affiliates asked the Texas Eighth Court of Appeals to halt a Dallas trial-court order that would force them to turn over trade secrets and financial records in a contract dispute. The appeals court granted emergency relief, freezing discovery until it decides whether the lower court has jurisdiction at all. The ruling matters because the same playbook—sue in state court, extract discovery, then jump to arbitration—could soon be used against crypto exchanges and DeFi protocols.
The fight started when Envy’s landlord, NV Landco, and its CEO Stephen DeCani sued a Dallas software vendor for breach and misappropriation of mining code. Early on, the plaintiffs invoked an arbitration clause buried in an earlier services agreement. The vendor countered that the clause was too narrow and asked the state judge to keep the case in open court. After the judge ordered broad document production, the plaintiffs ran to the appeals court claiming the entire proceeding should be stayed.
A three-judge panel sided with Envy on the stay but left the deeper jurisdictional fight for another day. The court ruled that forcing discovery while arbitrability is unsettled would cause “irreparable harm” to the plaintiffs’ confidentiality interests. In plain terms, the judges hit pause on the document dump, preserving the status quo until they decide who actually gets to rule on the merits.
The decision underscores a growing Texas pattern: state courts are willing to shield crypto projects from hostile discovery as long as a colorable arbitration clause exists. That tilts leverage toward exchanges and protocols that draft broad arbitration language, but it also warns traders that once an arbitration panel is seated, the same broad discovery can still happen behind closed doors.
Bottom line: the opinion buys blockchain firms time and secrecy, but it does not kill litigation risk—it simply moves the battlefield.
